Welcome to Trash Can Dudes. These Terms of Service & Website Terms of Use ("Terms") govern your access to and use of our website (trashcandudes.com) and our mobile trash bin cleaning services. By browsing this website, purchasing a one-time clean, or enrolling in a subscription package, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately cease using this website and our services.

1. Company Information & Service Area

Trash Can Dudes is located at 13239 S 1300 E, Draper, UT 84020. We provide trash bin high-pressure washing, sanitizing, and deodorizing services exclusively within designated residential and commercial areas of the State of Utah. We do not offer physical services outside of Utah.

No Walk-In Physical Location (No Customer Visits): Please note that the address 13239 S 1300 E, Draper, UT 84020 serves strictly as an administrative and equipment storage base. It is a private residence and is not a physical storefront or a customer service walk-in center. For the safety and privacy of our team, physical customer visits are strictly prohibited. All customer support, scheduling inquiries, sales, and business communications must be conducted remotely via text message, phone call, or email.

2. Services Provided & Technical Limitations

Cold Water Limitations: Trash Can Dudes utilizes commercial-grade portable pressure washing equipment connected directly to the Customer’s external cold-water tap. Our process uses manual agitation, high pressure, and balanced sanitizers.

No Guarantees or Warranties: All services are provided on an "as-is" and "as-available" basis. Trash Can Dudes makes no express or implied warranties or guarantees regarding the absolute removal of all stains or blemishes. Permanent structural stains, cured commercial paint, industrial adhesives, heavy motor oil discoloration, or chemical burns fused to the plastic cannot and will not be removed.

3. Customer Obligations & Water Source

Water Access: The Customer must provide Trash Can Dudes with clear, unobstructed access to an operational outdoor garden hose spigot (water tap) on the day of scheduled service.

Bin Placement: Bins must be left completely empty at the curb or in a designated, easily accessible location on the scheduled service day. Trash Can Dudes will not handle or empty residential trash to complete a service. Bins containing trash will be skipped, and no refund will be issued.

Safety: The Customer agrees to keep children and domestic pets safely indoors during the active washing process to prevent accidental contact with high-pressure spray or cleaning runoff.

4. Property Damage, Liability, & Weather Disclaimers

Water Runoff: Because our equipment connects to the client’s tap, surface runoff onto driveways, sidewalks, or lawns is an inevitable result of the service. Trash Can Dudes is not liable for naturally occurring runoff or water accumulation.

Freezing Temperatures & Black Ice: In accordance with cold-weather risks along the Wasatch Front, if temperatures drop below 32°F on a scheduled service day, Trash Can Dudes reserves the right to pause or reschedule service to prevent the formulation of hazardous black ice on concrete surfaces. Trash Can Dudes holds zero liability for any slips, falls, or property damage resulting from frozen water runoff.

Inclement Weather: We operate rain or shine. However, severe weather (thunderstorms, extreme winter storms) may result in automatic rescheduling to the next available clear day.

Pre-existing Bin Damage: Trash Can Dudes is not liable for breaking pre-existing brittle plastic, cracked lids, faulty wheels, or damaged hinges during the high-pressure cleaning process.

5. Subscription, Automatic Renewal, & Cancellation Notice

Billing: Subscription packages are billed automatically through the payment gateway on trashcandudes.com.

Utah HB 174 Compliance: In compliance with Utah consumer protection laws, subscription pricing, renewal dates, and billing amounts are clearly outlined at checkout. No long-term contracts exist.

10-Day Cancellation Notice Required: To cancel an automatic subscription, you must submit your cancellation request at least ten (10) days prior to your next scheduled billing date. Because our automated billing cycle processes payments in advance, we cannot halt or stop automatic billing once it has initiated.No Refunds Post-Billing: Once an automatic payment has been successfully processed and paid through the website, no refunds will be given under any circumstances, and service will be fulfilled for that paid period.

6. Website Terms of Use & Access License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use trashcandudes.com strictly for personal, non-commercial purposes, such as researching our services, managing your account, or placing bookings.

7. Intellectual Property Rights

All content displayed on trashcandudes.com including text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the exclusive property of Trash Can Dudes and is protected by United States and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, or distribute any material from this site without our express written consent.

8. Prohibited User Conduct

When using trashcandudes.com, you expressly agree that you will not:

- Use the website for any unlawful purpose or to solicit others to perform unlawful acts.

- Attempt to interfere with, disrupt, disable, hack, or compromise the security features or proper working order of the website or its host servers.

- Use automated bots, scrapers, spiders, or scripts to extract data from our platform.

- Submit false, fraudulent, or misleading information via our online booking form or customer accounts.

9. Limitation of Website Liability

To the maximum extent permitted by applicable law, Trash Can Dudes shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, trashcandudes.com. We do not guarantee that the website will operate completely error-free, uninterrupted, or free of viruses or other harmful digital elements.

10. Governing Law & Document Updates

These Terms, along with your use of the website and physical services, are governed exclusively by the laws of the State of Utah, without regard to conflict of law principles. We reserve the right to update, change, or replace any part of these Documents at any time by posting updates to our website. It is your responsibility to check our website periodically for changes. Continued use of our website or services following any updates constitutes automatic acceptance of those changes.

11. Dispute Resolution, Binding Arbitration, & Class Action Waiver

Mandatory Arbitration: You and Trash Can Dudes agree that any dispute, claim, or controversy arising out of or relating to this website, our services, billing, or these Terms shall be settled exclusively through binding, individual arbitration, rather than in a court of law. This arbitration will be administered by a neutral arbitrator in accordance with commercial arbitration rules.

Location of Arbitration: The arbitration shall take place locally within Salt Lake County, Utah, unless otherwise mutually agreed upon in writing by both parties. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction in Utah.

Class Action Waiver: YOU AND TRASH CAN DUDES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Small Claims Exception: Notwithstanding the mandatory arbitration agreement above, either party retains the right to bring an individual action in a Utah small claims court if the dispute qualifies for that court's jurisdictional monetary limits.
